Radio Interview On Krayeske Case

Why is the state refusing to negotiate on resolution of the case of a free-lance journalist arrested while taking a picture of the governor at a parade?

Should the case be tried, expect a subpoena of the governor herself. Police say Krayeske behaved in a suspicious and threatening manner. Before the arrest they distributed a flyer about him noting that he intended to protest at the governor's inaugural ball later that night.

Two problems with that theory: First, there is no law against protesting, so why treat Krayeske like a national security threat? Second, moments before the journalist was arrested, the governor was photographed looking right at him. She is smiling?
